Conditions of use

These Terms and Conditions are made on behalf of GP Amazing Products Pty Ltd. They apply to all purchases made from this website and together with your Order constitute the entire Contract between us and you for the supply of Products. The Contract cannot be varied unless we agree to vary it in writing or by email.

Product Information

The website gpamazingproducts.com.au is owned by GP Amazing Products Pty Ltd. All products listed on this website are described to the best of our abilities and the specifications reflect the information that has been provided to us. All care is taken to ensure this information is correct, but we cannot accept liability for any incorrect information. We reserve the right to change any specification, design, model and or other information without notice.

Typographical Errors

In the event a product is listed at an incorrect price or with incorrect information due to typographical error or error in pricing or product information, we shall have the right to refuse or cancel any orders placed for products listed at the incorrect price. We shall have the right to refuse or cancel any such orders whether or not the order has been confirmed and your credit card has been charged. If your credit card has already been charged for the purchase and your order is cancelled, we shall immediately issue a credit to your credit card account in the amount of the charge.

Product Availability

We cannot guarantee product availability and products, nonetheless, these items may not be available for immediate delivery. We reserve the right, without liability or prior notice, to revise, discontinue, or cease to make available any or all products or to cancel any order. If there is any revision, discontinuance, or cessation, we may, in our discretion, ship products which have substantially similar functionality and specifications to the products ordered or cancel your order.

Prices

All prices on this website are GST inclusive and in Australian Dollars.

GP Amazing Products always seeks to list Products with the most competitive prices.

GP Amazing Products reserves the right to change prices for Products displayed at GP Amazing Products at any time before you place an Order.

The price of products shown excludes shipping costs. The cost of shipping is clearly indicated and is included in the invoice total.

Payment Information

All orders must be prepaid unless prior arrangements are made.

Credit Card Payments

There are two ways to pay by credit card:

  1. Online via Paypal or e-Path at the time of placing your order, or
  2. By phone (we will call you) after placing your order.

When ordering by credit card, your credit card is charged when you place your order. If the credit card payment is declined by your issuer for any reason, we cannot hold goods against your order.

Bank Deposit/Bank Transfer Payment

Your Order Confirmation will contain details of our Bank Account if you choose this payment option.

Cheque/Money Order Payment

Orders paid for by cheque or Australia Post Money Order  (Australian orders only) will not be dispatched until such times as the funds have been cleared.  

Payment After Delivery ("Terms")

This method of payment is only available to approved business customers. It requires the correct company name and ABN to be submitted when registering. Business customers using non-company website email addresses such as "hotmail" ot "gmail" may require additional verification steps before an order can be processed for payment after delivery. All Invoices are due 14 calendar days after date of order placement.

Late Payment Fee

One rare occassions, it becomes neccessary to pass overdue invoices to our collections agency. In these cases, a handling fee of $30 wiil be payable in addition to any collection agency fees..

Transfer of Title and Risk

Title in the goods remains with GP Amazing Products Pty Ltd until payment is received in full. Risk in the goods transfers to you the buyer upon delivery to the address specified on your order.

Consumer Guarantees

Consumer guarantees apply under the Australian Consumer Law. Nothing in these Terms and Conditions excludes the application of those guarantees. For more information about your rights as a consumer, see the Australian Consumer Law website.

If a Product has a minor defect, we will provide a repair or offer you a replacement or a refund.

If a Product has a major defect, you are entitled to:

  • reject the goods and receive a refund
  • reject the goods and receive an identical replacement, or one of similar value if reasonably available, or
  • keep the goods and receive compensation for the drop in value caused by the problem.

If you think that a Product is defective you should contact our Customer Service Help Centre and a Customer Service Representative will assist you. Further information or a photo may be requested to assist with the assessment of your claim.

Where a Product is defective and needs to be replaced or repaired return shipping will be arranged at the expense of GP Amazing Products.

If a Product is replaced, your replacement Product becomes your property and the returned Product becomes our property. When a refund is given, the returned Product becomes our property.

Additional GP Amazing Products Warranties

GP Amazing Products offers a standard 1 year warranty on all electrical equipment sold. This is our warranty. You also have consumer guarantees under the Australian Consumer Law (see above).

If You Change Your Mind

GP Amazing Products offers a "30 day - No Questions Asked" refund policy, subject to our Returns Policy.

Limitation Of Liabilities

To the extent permitted by law,:

  • GP Amazing Products will not be liable for any loss of income, loss of profits, loss of contracts, loss of data or for any indirect or consequential loss or damage of any kind howsoever arising and whether caused by tort (including negligence), breach of contract or otherwise.
  • GP Amazing Product's maximum aggregate liability for any Product supplied to you whether in contract, tort (including negligence) or otherwise shall in no circumstances exceed the amount payable by you to GP Amazing Products in respect of the Product(s) in question.

Copyright

The website content, description & images of our products are the copyright property of GP Amazing Products Pty Ltd, or where applicable, our Suppliers or Manufacturers themselves, and specifically you may not use that description and/or images to re-sell the items elsewhere without written permission of the copyright holder.

General

You shall not assign any rights and obligations under these Terms and Conditions whether in whole or in part without the prior written consent of GP Amazing Products. Any unauthorised assignment shall be deemed null and void.

If any provision of these Terms and Conditions is held by any competent authority to be invalid or unenforceable in whole or in part, the validity of the other provisions of these Terms and Conditions and the remainder of the provisions in question shall not be affected thereby.

Neither our failure nor your failure to enforce any Term or Condition constitutes a waiver of such Term or Condition. Such failure shall in no way affect the right to later enforce such Term or Condition.

GP Amazing Products reserves the right to change these Terms and Conditions of sale at any time.

Force Majeure

To the extent permitted by law, GP Amazing Products is not liable for any delay in performing any of its obligations under these Terms and Conditions if such delay is caused by circumstances beyond the reasonable control of GP Amazing Products, and GP Amazing Products shall be entitled to a reasonable extension of time for the performance of such obligations.

Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of Victoria and shall be subject to the non-exclusive jurisdiction of the courts of Victoria.
